📄 TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Service.

2. Description of Service

The Service provides automated diagram conversion using artificial intelligence systems.

We may modify, suspend, or discontinue any part of the Service at any time without notice.

The Service is intended for general informational and productivity purposes only.

3. Accounts

To access certain features, you must create an account via our authentication provider.

You are responsible for:

Maintaining confidentiality of your credentials

All activity under your account

We may suspend or terminate accounts that breach these Terms.

4. Credits and Payments

The Service operates on a credit-based model.

Credits must be purchased in advance.

All purchases are final unless required by law.

Credits have no monetary value and are non-transferable.

A credit is consumed for each conversion attempt, including where uploaded content does not contain a visible flowchart or process steps that can be converted into a usable output.

We may change pricing at any time.

5. User Content

You are solely responsible for any content you upload or process using the Service.

You represent and warrant that:

You have all necessary rights and permissions to upload the content;

The content does not infringe intellectual property or other third-party rights;

The content complies with applicable laws.

6. Image Processing & Data Handling

Uploaded images:

Are processed transiently in memory for output generation;

Are not stored in persistent databases;

Are not included in application logs or error logs;

Are not retained after processing.

Uploaded images are transmitted to third-party AI providers solely for generating outputs.

7. Artificial Intelligence & Third-Party Processing

The Service relies on third-party artificial intelligence providers, including OpenAI.

According to OpenAI’s published API data usage policies at the time of writing:

Data submitted via the API is not used to train OpenAI’s models.

API data may be retained for up to 30 days for abuse monitoring and safety purposes.

We do not control the independent systems or policies of third-party providers and make no representations beyond their publicly available documentation.

AI-generated outputs may contain errors, omissions, or inaccuracies. You are solely responsible for reviewing and verifying outputs before relying on them.

The Service does not provide professional, legal, financial, or technical advice.

8. Intellectual Property

All rights, title, and interest in and to the Service — including software, branding, content, and underlying technology — are owned by us or our licensors.

You retain ownership of content you upload.

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable licence to use the Service.

You may not:

Reverse engineer the Service;

Copy or redistribute the software;

Use the Service to build a competing product.

9. Future Assignment

We may assign or transfer our rights and obligations under these Terms to a successor entity in connection with a business restructuring, incorporation, sale, or asset transfer.

Your continued use of the Service after such transfer constitutes acceptance of the updated operator.

(This clause makes it easy to move to a Pty Ltd later.)

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we make no warranties regarding:

Accuracy

Availability

Reliability

Fitness for a particular purpose

Security

We do not guarantee uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law:

Our total aggregate liability arising out of or in connection with the Service is limited to the greater of:

The total amount paid by you in the 12 months preceding the claim; or

AUD $100.

We exclude liability for indirect, incidental, consequential, special, or punitive damages, including:

Loss of profits

Loss of revenue

Loss of data

Business interruption

Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses arising from:

Your use of the Service;

Your uploaded content;

Your breach of these Terms.

13. Termination

We may suspend or terminate your access if you breach these Terms.

You may stop using the Service at any time.

14. Governing Law

These Terms are governed by the laws of Western Australia, Australia.

PRIVACY POLICY

1. Overview

We care about your privacy. We are committed to handling personal information responsibly and transparently.

While we may not currently be subject to all obligations under the Privacy Act 1988 (Cth), we aim to follow generally accepted privacy principles in operating the Service.

2. Information We Collect

We collect limited personal information necessary to operate the Service:

Email address (via authentication provider)

User ID

Account credit balance

Basic usage metadata (e.g., number of conversions)

We do not store uploaded images or generated outputs after processing.

3. Image Processing

When you upload an image:

It is processed transiently for output generation;

It is not retained after processing.

4. AI Providers & OpenAI

Uploaded images are transmitted to third-party AI providers, including OpenAI, solely for output generation.

According to OpenAI’s published API data usage policies:

API data is not used to train models.

API data may be retained for up to 30 days for abuse monitoring and safety purposes.

After this period, data is deleted unless legally required to retain it.

We do not control the independent policies of third-party providers beyond their published terms.

5. Third-Party Service Providers

We use third-party providers for:

Authentication

Payment processing

Cloud hosting

AI processing

These providers may process personal information on our behalf.

We encourage users to review their privacy policies.

6. Data Security

We implement reasonable technical and organisational safeguards to protect personal information.

However, no internet transmission can be guaranteed to be completely secure.

7. Data Retention

We retain account-related personal information only for as long as necessary to:

Provide the Service;

Comply with legal obligations;

Resolve disputes.
